Terms of Service

1. Acceptance of Terms

Welcome to Loma. By accessing or using our mobile application and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Loma ("we," "us," or "our"). We reserve the right to modify these Terms at any time with at least 30 days' notice for material changes.

2. Eligibility

You must be at least 13 years old to use Loma. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will use the Service only for lawful purposes
  • All information you provide is accurate and truthful

If you are between 13 and 18 years old, you must have your parent or legal guardian's permission to use the Service.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are solely responsible for all activity that occurs under your account. You must:

  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access or security breach
  • Not share your account with others
  • Not use another person's account without permission

We are not liable for any losses, damages, or costs arising from unauthorized use of your account due to your failure to maintain security.

4. Munchie Token System

4.1 What are Munchies?

Munchies are non-transferable tokens that allow you to generate personalized recipes. Each Munchie permits the generation of one recipe. Munchies have no cash value and cannot be exchanged for money.

4.2 Munchie Usage

  • Consumption: One Munchie is consumed each time you generate a NEW recipe
  • No Refunds: Munchies are non-refundable once used, even if you dislike the generated recipe
  • No Rollover: Unused Munchies do not carry over to the next billing period (except bonus Munchies earned through achievements)
  • Saved Recipes: Viewing, cooking, or re-accessing previously generated recipes does NOT consume Munchies
  • Expiration: Subscription Munchies expire upon subscription cancellation; bonus Munchies remain in your account

4.3 Earning Bonus Munchies

You may earn bonus Munchies by completing achievements, maintaining streaks, and reaching milestones. Bonus Munchies are subject to our discretion and may be modified or discontinued at any time.

5. Subscriptions and Payments

5.1 Subscription Plans

Loma offers weekly, monthly, and yearly subscription plans. Each plan includes a specified number of Munchies and full access to app features. Current pricing is available at lomameals.com/pricing.

5.2 Free Trials

New users are eligible for a 7-day free trial period. During the trial, you will receive 2 Munchies to generate recipes. You will not be charged if you cancel before the trial ends. If you do not cancel, your subscription will automatically begin, and your payment method will be charged.

5.3 Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. We do not store your credit card information. By providing payment information, you authorize us to charge your payment method for the subscription fees.

5.4 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel. You will be charged the then-current subscription price. We will provide at least 30 days' notice before implementing any price increases.

5.5 Cancellation

You may cancel your subscription at any time through the app's subscription settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that time. No partial refunds are provided for unused time.

5.6 Price Changes

We reserve the right to change subscription prices with at least 30 days' advance notice. Price changes will take effect at your next billing cycle. Continued use of the Service after a price change constitutes acceptance of the new price.

6. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any laws, regulations, or third-party rights
  • Engage in fraudulent, deceptive, exploitative, or harmful activity
  • Use the Service for personal, family, or household purposes in violation of our business-use terms
  • Circumvent technical limitations, disable functionality, or reverse-engineer the app
  • Decompile, disassemble, or attempt to derive source code
  • Rent, lease, sell, share, redistribute, or sublicense the Service
  • Use the Service as a pass-through agent or service bureau with no added value
  • Share account access with unauthorized users
  • Automate access to the Service (e.g., bots, scrapers)
  • Interfere with or disrupt the Service or servers
  • Upload malware, viruses, or harmful code
  • Misrepresent your identity or affiliation
  • Harass, abuse, or harm other users

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

7. Intellectual Property

7.1 Our Ownership

The Service, including all content, features, functionality, software, logos, and trademarks, is owned by Loma and protected by intellectual property laws. You may not use our intellectual property without our prior written consent.

7.2 Your Content

You retain ownership of any content you create (e.g., recipe reviews, feedback). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content for the purpose of operating and improving the Service.

7.3 Generated Recipes

Recipes generated by our AI are for your personal use. While you can access them indefinitely, you may not redistribute, sell, or commercially exploit them without permission.

8. Service Modifications and Availability

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will provide reasonable notice for material changes that adversely affect your use.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We are not responsible for delays, failures, or errors resulting from circumstances beyond our reasonable control.

9. Disclaimers

9.1 Health and Nutrition Disclaimer

IMPORTANT: Loma is not a substitute for professional medical, nutritional, or dietary advice. The recipes and nutrition information provided are for general informational purposes only. Consult a qualified healthcare provider before making significant dietary changes or if you have medical conditions.

We make no warranties about the accuracy, completeness, or suitability of nutrition information. Individual results may vary.

Allergen Responsibility: While Loma allows you to specify food allergies and restrictions during onboarding, you are solely responsible for verifying that all ingredients in generated recipes are safe for your consumption. We do not guarantee that recipes will be free from allergens or cross-contamination risks. Always read ingredient labels carefully and consult with a healthcare professional if you have severe allergies or dietary restrictions. Loma assumes no liability for allergic reactions or adverse health effects resulting from the consumption of recipes generated through our Service.

9.2 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOMA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Loma, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or create

12. Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service or other users
  • Non-payment of fees
  • Any reason at our discretion with notice

Upon termination, your right to use the Service immediately ceases. You may still access previously generated recipes for 30 days after termination, after which your account and data may be permanently deleted.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property or confidentiality matters.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Loma.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to any affiliate or successor.
